The general terms and conditions for companies that recruit through Java District.
Java District, we: Software District B.V. (KvK 94813167), Johan Huizingalaan 763a, 1066 VH Amsterdam, operating under the name Java District.
Hiring partner, you: the company or organization that has a company account or enters into an agreement with us.
User: an employee of the hiring partner who uses the platform on behalf of the hiring partner.
Developer: a person with a developer account on the platform.
Package: the subscription you purchase, such as Fasttrack or Partnership.
Quote: the offer accepted by both parties, including the package, price, and term.
Agreement: the quote together with these terms.
These terms apply to every use of the platform by a hiring partner, to every quote, and to every agreement. This also applies to a free company account, except for the provisions on payment.
They are intended for business use. The hiring partner's general terms and conditions, such as purchasing terms, do not apply.
If the quote says something different from these terms, the quote prevails.
The agreement is formed when you accept the quote or, for a free account, when you create the account.
Through Java District, you can present your company to developers, post vacancies, proactively search for developers and build your own talent pool. After a mutual match, you chat directly with the developer, without an intermediary. The features and number of vacancies included in your package are listed in the quote.
We do our best to help you recruit well, but we do not guarantee any number of matches, interviews or hires.
We are not a party to any application or employment agreement between you and a developer.
We may improve the platform and change features. If we substantially limit a feature listed in your quote, we will let you know in advance.
Only employees of the hiring partner get access, each with their own account on a business email address.
Login credentials are personal and may not be shared.
You are responsible for what your users do on the platform and make sure they are aware of these terms.
If you suspect misuse of an account, let us know right away.
You use the platform only to recruit for your own organization. Recruiting on behalf of third parties, for example as a recruitment, secondment or staffing agency, is not allowed unless we have agreed to this with you in writing.
Developers choose for themselves whether they are visible. Conversations only start after a mutual match. For data you receive from a developer through the platform, you are the controller under the GDPR. You agree that you:
use developer data only for recruitment and selection for your own organization;
do not pass that data on to third parties, do not export it to systems other than those needed for your own application process, and do not use it for marketing or newsletters;
do not approach developers outside the platform unless they have indicated that they want this;
do not discriminate on grounds such as origin, gender, age, religion, disability or sexual orientation;
do not make any decision about a developer based solely on an automated match or recommendation;
delete data as soon as you no longer need it for the application process, unless the developer consents to it being kept longer.
How we handle personal data ourselves is described in our Privacy Policy.
Vacancies and your company profile are accurate, up to date and compliant with the law. Any salary indication gives a fair picture.
You never ask developers for payment, such as application fees.
You give us permission to display your vacancies, company profile, name and logo on the platform. We may also mention you as a hiring partner on our website and in our communications, unless you tell us you do not want this.
We may refuse, edit or remove content if it violates the law or these terms. If we do, we will tell you why.
Prices are listed in the quote and exclude VAT.
We invoice monthly in advance, unless the quote states otherwise. You pay within 14 days of the invoice date.
If you do not pay on time, we will first send a reminder. If payment is still not made after that, we may charge statutory commercial interest and collection costs and suspend access to the platform.
Prices stay the same during the term set out in the quote. On renewal, we may adjust prices. We will let you know at least 2 months in advance.
The term of your package is set out in the quote. For Fasttrack it is 6 months, for Partnership 1 or 2 years.
After the term, the agreement continues on a monthly basis. You can then cancel at any time with 1 month's notice.
Early termination during the term set out in the quote is not possible, unless one of the parties seriously fails to meet its obligations and does not remedy this within 14 days of a written notice of default.
Either party may terminate the agreement immediately if the other party goes bankrupt or is granted a suspension of payments.
You can close a free company account at any time.
When the agreement ends, access to the paid features ends. You delete developer data you received through the platform within 30 days, except for ongoing application processes or if the developer has consented to it being kept longer. What we do with your account data is described in our Privacy Policy.
The platform, the software, the design and our content remain the property of Java District. During the agreement, you receive a non-exclusive, non-transferable right to use the platform for your own recruitment. You may not copy, automatically extract (scrape), replicate or resell the platform. Your vacancies and company profile remain yours.
Both parties keep the other's confidential information secret, such as pricing arrangements and non-public information about the platform. Information about developers and the content of conversations with them is always confidential, and you only share it internally with people involved in the recruitment.
Our liability is limited to direct damage and to no more than the amount you paid us in the 12 months before the damage occurred. For a free account, this is no more than €500.
We are not liable for indirect damage, such as lost profits or missed hires, nor for the choices or conduct of developers.
These limitations do not apply in the case of intent or deliberate recklessness by our management.
You must report a claim in writing within 12 months of discovering the damage.
You indemnify us against claims from developers or others that arise because you or your users fail to comply with these terms or the GDPR.
Neither party is liable if an obligation cannot be fulfilled due to force majeure, such as an outage at a hosting or internet provider, a cyberattack or government measures. If the force majeure lasts longer than 60 days, either party may terminate the agreement in writing.
We may change these terms. We will notify you of changes at least 30 days in advance. If they are substantially to your disadvantage, you may terminate the agreement as of the date the change takes effect.
The agreement is governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam. Questions? Email info@javadistrict.eu.
